GENERAL
The following general terms and conditions regulate conclusively and exclusively the conclusion of the contract and its implementation. ______________ GmbH (hereinafter: “Sorry, What? - Escape”), __________Berlin (hereinafter: “Customer”) offers services and products in the area of escape games. The Sorry, What? - Escape reserves the right to change, close or remove any item for technical, operational or other reasons without prior notice. In such cases, the entry price cannot be refunded.
1 contract conclusion
1.1 Registration for the event can be done via the website, by telephone or by email. The website (www.sorrywhat.eu) offers escape games, city rallies and online games for booking as well as vouchers for these leisure activities. The presentation and promotion of the various products do not constitute a binding offer to conclude a contract. The customer can choose between the events offered. Free appointments result from the calendar view provided. By confirming the “checkout” button, the customer registers bindingly for the game in the desired time slot during the booked period. To book the event, please ask Sorry, What? - Escapes first data such as the customer's name, email address, telephone number and, if applicable, billing address. By submitting the order by clicking on the “Order with obligation to pay” field, the customer submits a binding offer. Only when the order number has been allocated and sent by Sorry, What? - Escape to the customer comes a contract between the customer and the Sorry, What? - Escape accomplished. Sending the order confirmation is the delivery of the ticket for participation in the event. Before submitting the booking, the customer can view and change their entries at any time. The booking confirmation must be checked by the customer immediately; Any errors are subject to the Sorry, What? - Notify Escape in writing. When booking via email or telephone, the customer can also choose between the offers and provide the required information.
If the customer has ordered a voucher, the voucher code will be sent to him in the booking confirmation in the form of an email. This entitles the customer or a person to whom the customer passes on the voucher to use the voucher amount as a means of payment when booking escape games and paying at the location for the game.
2 cancellation
2.1 The purchase of vouchers can be revoked in accordance with No. 6.
2.2 When purchasing tickets for participation in escape games and rallies, cancellation is not possible (see No. 6.1.). This applies regardless of the payment method chosen.
Our goodwill regulations:
You can cancel or rebook appointments free of charge up to 7 days before the event. Please send an email to _______@_________ with the booking number and the change request.
Within 7 days to 48 hours before the event, you can rebook free of charge or the ticket price can be converted into a voucher. The voucher is valid for 6 months.
For cancellations and rebookings made less than 48 hours before the start of the game, a cancellation fee of €50 per room will be charged. The remaining amount will be converted into a work voucher.
3 payment
3.1 After the order has been placed, the total price is due immediately for payment using Paypal, Sofortüberweisung, credit card, GiroPay and invoice after conclusion of the contract if these payment methods are offered.
3.2 If the payment method “cash payment on site” is offered, in deviation from 3.1, the total price of the order is due on the day of the event and must be paid in cash at the branch before the start of the game. Payment with EC card or credit card is possible.
4 Subject of the “Tickets” contract
4.1 Please note that Sorry, What? - Escape is a live event. If the customer arrives late, the playing time will be reduced in accordance with the delay. In the event of no-show, the customer's right to have the event held expires. The obligation to pay the total price of the order remains, see section 3.
4.2 The ticket purchased by the customer for participation in the escape game entitles the customer and other persons named by him to take part in the booked game on the date noted on the ticket (order confirmation) at the time specified.
4.3 Sorry, What? - Escape is a team game for people ages 10 and up. Children up to 14 years of age must be accompanied by a legal guardian. Otherwise, access may be denied. The escape games offered are generally not suitable for children under 10 years of age. The minimum age may vary for individual stories/events. This is then noted on the website and the minimum age applies there.
4.4 From the age of 6, children are considered “full-paying” guests when accompanied by adults in the playrooms. Children under 6 years of age can join the game free of charge after written agreement in accordance with the number of adults, but the maximum number of participants and the special features of the event must be observed. This regulation can be used in the context of separate group conditions from Sorry, What? - Escape can be canceled.
5 vouchers
5.1 Vouchers for a leisure event can be purchased via the website and directly on site. The vouchers are only valid for the payment of tickets for participation in leisure events organized by the Sorry, What? - Escape will be offered.
5.2 A claim for cash payment of the vouchers against the Sorry, What? - Escape is excluded as long as the service is offered.
5.3 Vouchers are valid for three years from the date of purchase.
6 Right of withdrawal
6.1 When purchasing tickets to participate in escape games, the Sorry, What? - Escapes and the customer enter into a contract for the provision of services in connection with leisure activities, which provides for a specific date or period of time for the provision (see Section 312 g Paragraph 2 No. 9 BGB). There is therefore no right of withdrawal for the customer in accordance with Section 312 g Paragraph 2 No. 9 BGB, regardless of the payment method chosen. Any purchase of tickets for participation in escape games is therefore immediately after confirmation in accordance with 3.1 by the Sorry, What? - Escape binds and obliges to pay the total price of the order.
6.2 Right of withdrawal when purchasing digital goodsWith the buyer's consent to the cancellation policy, when purchasing a digital good, the buyer agrees that the executing company will begin executing the contract before the end of the cancellation period and that the digital good will be made available to the customer. In addition, the buyer agrees that he loses his right of cancellation once the execution of the contract begins.6.3 The purchase of a voucher that takes place in the simultaneous physical presence of the contractual partners or their authorized representatives (e.g. purchase in the branch) does not constitute a distance selling contract within the meaning of Section 312 b BGB. The customer therefore has no right of withdrawal.
6.4 For all other voucher purchases, the following applies to contracts with consumers:
6.4.1 Cancellation policy
6.4.2 Right of withdrawal
You have the right to cancel this contract within fourteen days without giving any reasons. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods. In order to exercise your right of withdrawal, you must inform us, at ___________ GmbH, __________ Berlin, info@_____________, by means of a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract. In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period expires.
6.4.3 Consequences of revocation
If you revoke this contract, we must repay all payments that we have received from you immediately and at the latest within fourteen days from the day on which we received notification of your revocation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment. We may refuse repayment until we have received the goods back or you have provided evidence that you have sent the goods back, whichever is the earlier. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day period has expired. You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functionality of the goods.

6.5 The Sorry, What? - Escapes deactivates the voucher. If the voucher has already been paid for before cancellation, the Sorry, What? - Escapes the purchase price to the customer.
7 Image and video recordings while carrying out the leisure activities
7.1 The customer agrees to be observed via a screen by the game leaders while carrying out the leisure activities. This is for the safety of customers. The recordings are not saved.
7.2 We would also like to point out that surveillance cameras are installed in the entrance and lounge areas.
8 information on data protection and data processing
8.1 The Sorry, What? - Escapes collects customer data as part of the processing of contracts. Please note Sorry, What? - Escapes in particular the provisions of the Federal Data Protection Act and the Telemedia Act. Without the customer's consent - for example in accordance with the data usage declaration provided by the customer, Sorry, What? - Escapes only collect, store, process or use the customer's personal data to the extent that this is necessary for the processing of the contractual relationship and for the use and billing of telemedia.
9 Retention of title
9.1 The Sorry, What? - Escapes reserves ownership of the purchased item until the total price of the order has been paid in full if the customer is a consumer. The corresponding security interests can be transferred to third parties.
9.2 If the customer is an entrepreneur who acts as part of his business activity or a special fund under public law or a legal entity under public law, the Sorry, What? - Escapes retains ownership of the purchased item until all outstanding claims arising from the business relationship with the customer have been settled. The corresponding security interests can be transferred to third parties.
10 Liability, exclusion of withdrawal in the event of certain breaches of duty
10.1 Subject to the following exceptions, the liability of Sorry, What? - Escapes for contractual breaches of duty and tortious acts are limited to intent or gross negligence. In the following cases, Sorry, What? - Escapes unlimited: according to the Product Liability Act, for damage caused intentionally or through gross negligence, for fraudulent concealment of defects, for damage resulting from injury to life, body or health and for damage resulting from the violation of a guarantee.
10.2 If a violation of essential contractual obligations (so-called cardinal obligations) is based only on simple negligence, the liability of Sorry, What? - Escapes to compensation for contract-typical and foreseeable damage.
10.3 Except for the cases mentioned in paragraphs 10.1 and 10.2, the Sorry, What? - Escapes will not be held responsible for damage caused by simple negligence.
10.4 The Sorry, What? - Escapes is not liable for lost wardrobe or lost or lost valuables. Sorry, What? - Escapes assumes no duty of care in this regard. The Sorry, What? - Escapes assumes no liability for items of clothing that are damaged during the leisure activities.
10.5 We also point out that the existing premises and products have technical facilities, such as: B. 12 V magnets, flickering lights and natural products can have symptoms of diseases such as. B. can trigger epilepsy or allergies. The Sorry, What? takes over for this. - Escapes no liability.
10.6 As far as the liability of Sorry, What? - Escapes is excluded or limited in accordance with Sections 10.1 to 10.5, this also applies to the liability of its vicarious agents and vicarious agents.
11 Applicable law and place of jurisdiction
11.1 The law of the Federal Republic of Germany applies exclusively.
11.2 If the customer is an entrepreneur in accordance with Section 14 of the German Civil Code (BGB), the sole place of fulfillment for delivery and service as well as payment is the headquarters of Sorry, What? -Escapes.
11.3 The European Commission provides a platform for online dispute resolution (OS), which you can find here: EU Commission platform for online dispute resolution: www.ec.europa.eu/consumers/odr Consumers have the opportunity to do so to use the platform to resolve their disputes.
12 Sorry, What? - Escape's house rules
With access to the event rooms of Sorry, What? - Escapes customers and visitors acknowledge the validity of the house rules regulated by private law below:
1. People who attract attention by wearing fascist and/or inhumane emblems, brands and/or by making fascist and/or inhumane statements will be expelled from the event premises and will be immediately banned from entering the premises!
2. Cutting, shooting or stabbing weapons are prohibited in the event rooms.
3. The creation of photo, audio, video or other media recordings for commercial use in the facility without the express prior consent of Sorry, What? - Escapes are not permitted. For the sake of the gaming experience, we also ask that you hand in any image and sound recording devices, especially mobile devices, before the game begins. 4. For the safety of our customers and to protect themselves, animals are not allowed in the event rooms.
5. Visitors who are obviously under the excessive influence of drugs or alcohol, who are suspected of having an infectious disease within the meaning of the Federal Diseases Act or the Infection Protection Act or similar illnesses that endanger safety may be denied access to the premises.
6. If the house rules stated here, the rules of the game explained in the briefing or the instructions in the game are not followed, we reserve the right to cancel the game. In this case the ticket cannot be refunded.
